19.4 REDUNDANCY Redundancy is a special form of dismissal. An employee can be dismissed for redundancy when there is a genuine business case for Byron to do the following in order to maximise business performance. • Reduce the size of its workforce • Closes one of the Byron restaurants •  Certain roles and responsibilities are no longer needed or can be amalgamated with another role Please refer to the Redundancy Policy for further details. 19.5 COMPANY PROPERTY Once your employment has ended with Byron, you must return all Company property.This includes Company data/documents, uniforms and equipment provided by Byron. All property should be returned to Byron on or before your last day. If you fail to comply, Byron reserves the right to take appropriate steps to recover the property. 19.6 CONFIDENTIALITY When you joined, you agreed to keep company information confidential.This applies even after you’ve left us. Please honour this commitment. 19.7 FINAL PAY On leaving, your final pay may be subject to the following deductions: •  Overtaken accrued holiday •  Any overpayments made to you •  Any outstanding loans •  Cost of any Byron property that has not been returned If the amount to be deducted exceeds what you are due in your final pay, you must pay any outstanding balance to Byron. 51 19.LEAVINGBYRON Should you decide that it is time to leave Byron, please speak to your manger about it and put your resignation in writing, confirming your reasons for leaving and when your last working day will be. 19.1 NOTICE PERIOD Your employment may be terminated by notice either by yourself or by the Company. Please refer to your contract which will outline your notice period. Byron reserves the right to make payment in lieu of notice and payments in lieu of accrued but unused holiday entitlement The rights to all or part of the notice period may be waived by mutual consent There is no entitlement to notice from Byron if your employment is terminated on the grounds of gross misconduct Should you choose not to work all or part of your notice period, you will be paid up to and including what you have worked, including any holidays accrued up to and including your leaving date. However, you will not be paid your notice period as you will not have worked it. 19.2 DURING NOTICE During your notice period, whether notice has been given by you or us, we may require you to do the following: • Take any outstanding accrued holiday •  Re-allocate you to different duties, which may be less senior than you were carrying out •  To work at a different location for some or all of your notice period •  To go on ‘garden leave’ (to not work and remain at home during normal working hours). During garden leave, we are not obliged to provide you with work, but we would pay you and so you could not work elsewhere during this time.You also would need to be available to come into work should you be asked to do so. 19.3 RETIREMENT If you are starting to consider your retirement from Byron, we will be happy to discuss your options with you.
