The first six weeks of SMP is paid at 90% of your average earnings and the remaining 33 weeks are paid at 90% of your average weekly earnings or the SMP rate, whichever is lower. SMP rates normally increase each April. Don’t qualify for SMP? If you do not qualify for SMP, a SMP1 form will be e mailed to your restaurant stating the reason why you don’t qualify. This can be taken to your local Department for Work and Pensions or Jobcentre Plus office who will advise you about any payment you may qualify for. 9.9 PATERNITY PAY Statutory Paternity Pay (SPP) is for fathers and adoptive fathers entitling them to 2 weeks leave at SPP rate or 90% of your average weekly earnings, whichever is lower. If your average earnings are below the statutory rate but high enough to be paid SPP you will not receive the full statutory rate, you will be paid at your average earning. 9.10 ADOPTION PAY Statutory Adoption pay is paid for up to 39 weeks.You will be paid at 90% of your average weekly earnings for the first 6 weeks and then either the statutory rate or 90% of your average weekly earnings (whichever is lower) for the next 33 weeks. It will be paid via BACS direct to your account on the same dates you would normally receive your pay. 9.11 SHARED PARENTAL PAY If you and your partner is eligible and opt for shared parental leave you could be paid Statutory Shared Parental Pay (ShPP) for up to a maximum of 37 weeks. Please see the Family Leave Booklet for more details on Maternity, Paternity, Adoption and Shared Parental pay. 9.12 GENDER PAY In line with current legislation around Gender Pay Reporting we have carried out Gender Pay reporting under the equality act 2010 with statutory calculations showing what the pay and gender gap is between our male and female employees, this report can be found on our Pickle our Intranet, our website and gov.uk 9.13 ALL EXPENSES Byron will reimburse you for any reasonable business expenses that you incur whilst carrying out your normal day to day work.The Expenses Policy explains the procedure for claiming expenses and what you are entitled to claim for. 23 9.PAYcontinued 9.5 BONUS You may be eligible to participate in the company bonus scheme.The rules and criteria relating to the specific scheme will be discussed with you where applicable. •  Be aware that bonuses and similar arrangements always remain at Byron’s complete discretion •  We reserve the right to vary the terms of any scheme at any time, whether generally or for a specific individual For further information on the bonus scheme please speak to your manager or refer to the relevant bonus scheme. 9.6 HOLIDAY PAY Holiday pay is paid for agreed absences within your entitlement at your basic rate of pay. If you are hourly paid, then your holiday rate of pay will be calculated over a 12-week period. If you leave Byron, any unused holiday entitlement will usually be added to your final pay. If you leave having taken more holiday than you have accrued, this may be deducted from your final pay. If the overpayment is more than your final pay, you will owe the company the balance immediately and we will write to you to ensure you are aware of this outstanding balance and to arrange a repayment from you. 9.7 STATUTORY SICK PAY (SSP) If you miss work through illness and you qualify for SSP you will be paid at the current SSP rate. Sick pay is paid at the statutory sick pay (SSP) rate unless your contract of employment stipulates that you are eligible for company sick pay. Company sick pay is paid at your manager’s discretion. Statutory sick pay (SSP) is payable if you have been absent for more than three consecutive days and is payable on the fourth consecutive day of absence. 9.8 STATUTORY MATERNITY PAY Statutory Maternity Pay (SMP) is a state benefit paid by the Company and replaces your normal pay while you are on Ordinary Maternity Leave of up to 39 weeks (additional maternity leave is unpaid). It will be paid via BACS direct to your account on the same dates you would normally receive your pay. How is SMP calculated? Your ‘average earnings’ will be calculated using the hours worked during the qualifying period according to the Statutory Maternity Pay regulations.
